The growing popularity of products based on alternative cannabinoids, sold on websites like Sixty8.ro, HHCGuru.ro, or KushKings.ro, often hides significant legal dangers for consumers in Romania.

As a lawyer specializing in drug legislation, I am observing an alarming increase in criminal cases initiated following the identification of packages containing these products. Recent legislative changes, particularly concerning HHC, have a major impact and aggravate the risks. This article aims to clarify the legal situation and provide specific answers to the most common questions.

Marketing vs. Legal Reality: Why You Shouldn’t Believe Everything You Read

On websites selling products with HHC, THCA, HEC-10, 10-OH, CBG9, CBD, CBN+, etc., transparency regarding the legal risks you expose yourself to as a client is often minimal or non-existent. Many of these platforms do not provide clear information about the legal entities behind them or the countries from which they operate, and they knowingly omit warnings that they bear no responsibility for the consequences of your order.

A common tactic is to guarantee a THC content of < 0.3%. This limit, while relevant in other countries, is not recognized as such in Romania by the criminal authorities (Romanian text).

The Strict Interpretation of Legislation in Romania

It is crucial to understand that Romanian legislation is interpreted very strictly by prosecution bodies and courts. Any order for “flower/hash” type products (regardless of the declared THC/CBD content) and products with HHC (after March 29, 2025) carries a very high risk of a criminal case being opened and severe penalties being imposed. For other new cannabinoids, the legal uncertainty remains extremely high, and caution is absolutely necessary

Legal Analysis by Product Category:

a) Plant-based products (flowers/buds, hash) with CBD, HHC, etc.

  • Legal Status: ILLEGAL
  • Important:
    • The declared THC concentration is irrelevant.
    • The mere presence of plant material from the cannabis plant (leaves, inflorescences) or resin (hash) is considered sufficient for Romanian authorities to criminally prosecute.

b) Vapes and liquids with HHC (Hexahydrocannabinol)

  • Legal Status: ILLEGAL
  • Potentially very serious consequences (for offenses committed AFTER March 29, 2025):
    • International trafficking of risk drugs (art. 3 para. (1) of Law 143/2000), if the products are ordered from abroad:
      • Penalty: imprisonment from 5 to 15 years.
    • Possession for personal use is also a crime:
      • Penalty: imprisonment from 3 months to 2 years or a fine.

c)  Vapes and liquids with other new cannabinoids (HHC-O, HHC-P, THCA, 10-OH, CBG9, HEC-10, etc.)

  • Legal Status: UNCERTAIN, HIGH RISK
    • These compounds are often successors or derivatives of HHC.
    • The process of banning them at the European level is ongoing.
  • Potential risks in Romania:
    • Depending on the specific substance detected, these new cannabinoids:
      • May be contaminated with banned cannabinoids:
        • Lab tests may detect the presence of already banned cannabinoids (HHC, THC), even if they are not listed on the label.
      • May be classified under Law 194/2011:
        • They can be considered products likely to have psychoactive effects (trafficking operations are prohibited, but possession for personal use is not criminalized under this specific law).
  • Specific Clarifications:
    • HEC-10/HHX:
      • Commercial terms for cannabinoid blends (possibly containing CBN, CRD, 10-OH-HHC, CBC, CBT). Legality depends on the individual status of each component.
    • THCA:
      • It is the direct precursor to THC.
      • Through decarboxylation (e.g., by heating or simple exposure to light), THCA converts into THC.
      • It is practically impossible for a THCA product not to also contain THC, which brings risks under Law 143/2000.

Conclusion

The sellers of these products rely on ignorance of the law and the desire to access seemingly “legal” alternatives to cannabis. Do not be misled by aggressive marketing and promises of “legality“.

  • Avoid placing orders: The firm recommendation is not to risk your freedom by ordering from such sites, especially when the products are shipped from abroad.
  • Recently ordered packages: If you have recently placed an order and have not yet received it, the most prudent course of action is not to collect the package.
  • Your rights: If you are investigated, you have the right to remain silent, the right not to incriminate yourself, and, crucially, the right to a lawyer from the very first interaction with law enforcement.
